At Presight, protecting your privacy and securing the Personal Data you provide is our top priority. We value your trust and are committed to responsibly handling your Personal Data in accordance with applicable data privacy laws and regulations.

This Privacy Notice outlines how we collect, use, share, process, and protect your Personal Data when you engage with our websites, applications, and services (collectively referred to as “Services”). It also details your rights regarding your Personal Data and how we ensure compliance with applicable privacy laws.

When we mention “Presight,” “our,” “us,” or “we,” we are referring to Presight AI Holding PLC and its group of companies. Terms such as “you” and “your” refer to individuals who use our Services.

This website is not intended for children and we do not knowingly collect data relating to children.

Who We Are

The legal entity with responsibility for controlling how your Personal Data is used and protected is Presight AI Ltd., a private company limited by shares established in the Emirate of Abu Dhabi and whose principal address is at Level 17, Al Maqam Tower, Abu Dhabi Global Market Square, Al Maryah Island, Abu Dhabi, United Arab Emirates. Generally this entity is referred to as the ‘data controller’ under applicable privacy regulations.

If a different entity acts as the data controller, or if there is a joint controller arrangement where two entities share responsibilities as data controllers, we will inform you at the time your Personal Data is collected.”

Information Covered By This Privacy Notice

This Privacy Notice covers Personal Data collected and processed by Presight with regard to our Services. “Personal Data” means information that (either in isolation or in combination with other information held by us) enables you to be identified as an individual or recognized directly or indirectly. This Privacy Notice does not apply to the processing of Personal Data related to Presight employees or contractors.

What Information Do We Collect From You?

We collect Personal Data from you from different sources. Personal Data will be provided by you directly, or through interactions with our Services. The type of Personal Data collected will depend on your privacy settings, the Services you use, and the extent of your interactions with us. We may also receive Personal Data from our affiliates or other third parties to the extent allowable under law.

You remain in control of the Personal Data that you want to share. Some Services require specific types of data to function, and if not provided, those products or features may be unavailable. Additionally, if we are required to collect Personal Data by law or to fulfil obligations under a contract, if you decide not to share this information then we may be required to cease our interactions or Services with you.

Information You Give Us

You choose to provide Personal Data when you use our Services, such as when you:

  • Download and use a Presight application such Presight Connect, Presight Vitruvian BI, or any other application of ours that links to this Privacy Notice.
  • Engage with us in other related ways, including when applying for open job positions, or interacting at sales or marketing events.
  • Communicate with us either electronically, through mail, or through telephone.

This includes, but not limited to, the following types of Personal Data:

  • Name and general contact information – first and last name, date of birth, email address, physical mailing address, phone number, photo, beneficiary and emergency contact details, and other similar contact data.
  • Username and password – such as when you use a Presight application.
  • Preferences – when you access our website.
  • Video, voice and images – we may collect and use your video, voice and image data, subject to applicable laws.
  • National identifiers – your national ID/passport where it may be required to access our Services or facilities or required under law.
  • Work history – when you apply for a role you may provide your academic and professional qualifications, education history, CV, employment history etc.
  • Financial information – should we require payment you may provide card or bank account details.
  • Other information that you may voluntarily input into any of our Services.

Presight does not process ‘special categories’ of Personal Data such as your health information, racial origin, religious beliefs, or otherwise defined under the ADGM Data Protection Regulations 2021 or other applicable data privacy law, for the purposes of our Services.

Information We Collect About You

We will collect information about your use of our Services, your preferences in this regard, and details of transactions you make with us.

When you visit our website, we will use, only with your explicit consent, cookies and other technologies to automatically collect the following information:

  • Technical information, including the Internet Protocol (IP) address used to connect your computer to the internet, your login information, browser type and version, device identifier, location and time zone setting, browser plug-in types and versions, operating system and platform, page response times, and download errors.
  • Information about your visit, including the full Uniform Resource Locators (URL) clickstreams to, on and from our websites; length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouseovers), and methods used to browse away from the page.

Information We Receive and Collect from Other Sources

We may receive information about you from third parties or publicly available sources. This includes:

  • Technical data is collected from analytics providers;
  • Contact, financial and transaction data from providers of technical, payment and delivery services; and
  • Identity and contact data from publicly available sources such as social media.
How Do We Use Your Personal Data?
We use your Personal Data to:   How do we use Personal Data for this purpose?   What is the legal basis for us processing your information in this way?  
Provide you with Services you request from Presight. Such as when you register as a user of Presight applications, such as Presight Connect, Presight Vitruvian BI, or any other Presight application that links you to this Privacy Notice. We will need to use your Personal Data such as identity, contact and financial information where this is necessary for us to perform our obligations under a contract with you. We will need this information to give you access to these applications or process payments. Using your Personal Data in this way is necessary for us to perform our contractual obligations to you, as well as for our legitimate interest (to recover debts due to us).
Contact you to provide you with information about Presight’s Services and latest offers including tailoring such information to your interests (e.g. based on your browsing history and purchase history, provided you have consented to this) only with your explicit consent. We will need to use your Personal Data (such as your email address or other contact details) to send you information about our latest offers that you may be interested in. Please note we may also share your Personal Data with other entities within Presight for this purpose. We will ask for your consent before processing your Personal Data in this way.
To manage our relationship with you, which will include notifying you about changes to our terms or Privacy Notice and dealing with your requests, complaints and queries. We will need to use your identity and contact information. Using your Personal Data in this way is necessary for us to perform our contractual obligations to you, as well as to comply with our legal obligations, and for our legitimate interests (to keep our records updated and manage our relationship with you).
Comply with legal requirements and exercise or defend legal claims. We may sometimes need to process Personal Data to comply with legal requirements to which we are subject. For example should a regulator request information that includes your Personal Data or to provide you access to our facilities we may require a copy of your ID. It is in our legitimate interests to process Personal Data for the purposes of exercising and defending legal claims. Processing Personal Data may also be necessary to ensure compliance with Presight’s legal obligations.
Process your payments and protect against fraudulent transactions. We may need to process your Personal Data in order to keep your payments safe and secure and protect against fraudulent transactions. To keep payments secure and to prevent fraud. Processing Personal Data in this way may also be necessary to ensure compliance with the Presight’s legal obligations. \
Process your Personal Data where this is necessary to keep our website safe and secure (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data). We may need to process your Personal Data where it is to keep our website safe and secure and protect against illegal or fraudulent activity such as cyber attacks. Presight has a legitimate interest in keeping its website and servers secure.
As part of the recruitment process should you respond to a job posting on our website, or any other website. As part of any recruitment Process we will collect and Process the Personal Data of candidates at various stages. This will include assessing your experience and work history with the job requirements as well as conducting checks into your background and work history. The legal basis for Processing this Personal Data is our legitimate interest in screening and evaluating candidates as well as your consent when you submit an application.
Monitor to access to our facilities for security purposes. CCTV and other monitoring technology is utilized to secure our facilities and is a legal requirement in some of the jurisdictions we operate in. We have a legal requirement for CCTV facilities in some of our facilities. We also have a legitimate interest in securing our facilities for individuals safety and protection of assets.
Conduct KYC and compliance due diligence checks on our counterparties’ shareholders, beneficial owners, and key employees. Should you or your employer be contracting or transacting with us, we are required to conduct risk based due diligence on these counterparties. This will require identifier information and identification documents of shareholders, beneficial owners, and key employees that will be used for screening against compliance obligations. We are required by law to ensure that we do not transact with sanctioned or otherwise restricted persons and entities. It is also in our legitimate interest to ensure we transact and enter into business relationships with counterparties that meet our compliance obligations.

We make sure we consider and balance any potential impact on you and your rights before we process your Personal Data for our legitimate interests. We do not use your Personal Data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

Transfers of Personal Data
Our Service Providers

We use other companies, agents, or contractors (“Service Providers”) to perform services on our behalf or to assist us with the provision of services to you. In the course of providing such services, these Service Providers may have access to your Personal Data. However, these Service Providers are contractually bound only to use Personal Data to perform the services that we hire them to provide. We will always use our best efforts to ensure that all the Service Providers we work with will keep your Personal Data secure.

Third Parties Permitted By Law

In certain circumstances, we may be required to disclose or share your Personal Data in order to comply with a legal or regulatory obligation (for example, we may be required to disclose Personal Data to the police, or to judicial or administrative authorities). We may also disclose your Personal Data to third parties in order to enforce our terms and conditions or other agreements, or to protect the rights, property, or safety of Presight or the public.

Third Parties Connected With Business Transfers

We may transfer your Personal Data to third parties in connection with a reorganization, restructuring, merger, acquisition, or transfer of assets, provided that the receiving party agrees to treat your Personal Data in a manner consistent with this Privacy Notice.

Affiliates

We may disclose Personal Data to an affiliate of Presight such as other members of the G42 Group, in accordance with ADGM data privacy and protection laws.  Our affiliates may use the Personal Data we share in a manner consistent with this Privacy Notice.

International Transfers

Should we need to transfer your Personal Data out of your jurisdiction, we will implement appropriate safeguards and security measures. For jurisdictions that have not received an adequacy decision from the ADGM or other applicable regulator, we implement safeguards, including ADGM-compliant standard contractual clauses and equivalent measures, to ensure your Personal Data receives the required level of protection under this Privacy Notice and applicable laws. This includes cases where we transfer your Personal Data between the ADGM freezone and UAE mainland.

Where We Store Your Personal Data

The Personal Data that we collect from you may be transferred to, and stored at, a destination outside the ADGM. It may also be processed by staff operating outside the ADGM who work for us or for one of our Service Providers. We will take all steps that are reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Notice and applicable data protection laws, including, where relevant, entering into ADGM standard contractual clauses (or equivalent measures) with the party outside the ADGM receiving the Personal Data.

Security of Personal Data

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any Personal Data we process. All information you provide to us via our website is stored on our secure servers. Any payment transactions carried out via our website will be encrypted using Transport Layer Security (TLS) technology version 1.2 or higher.

Presight has taken steps to safeguard the confidentiality of its communications and computing infrastructure, including by implementing authentication, monitoring, auditing and encryption technology.

In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instructions, and they are subject to a duty of confidentiality.

Despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We cannot guarantee that unauthorized third parties, such as hackers or cybercriminals, will never defeat our security and improperly collect, access, steal, or modify your Personal Data. Although we will do our best to protect your Personal Data, transmission of Personal Data to and from our Services is at your own risk. You should only access the Services within a secure environment.

We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. The ADGM regulations require notifying the Office of Data Protection of certain types of breaches within 72 hours and Presight will comply with such requirements.

If at any point you suspect or become aware of a security incident (e.g. you receive a suspicious communication from someone holding themselves out to be our employee or from a unauthorised website claiming to be affiliated with us), please forward the communication to us or report the incident by email to [email protected], as soon as possible.

How Long Do We Keep Your Personal Data?

Your Personal Data is stored by us and/or our Service Providers, strictly to the extent necessary for the performance of our obligations and strictly for the time necessary to achieve the purposes for which the information is collected, in accordance with applicable data protection laws.

We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

When we no longer need to use your information, we will remove it from Presight’s systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it (unless we need to keep your information to comply with legal or regulatory obligations to which we are subject).

Third Party Websites and Apps

Presight’s website may contain links to and from third party websites. Please note that if you follow a link to any of these websites, these websites will have their own terms of use and privacy policies and that we do not accept any responsibility of liability for these policies. Please check these policies before you submit any Personal Data to these websites. If you decide to access linked third-party websites, you do so at our own risk.

Your Rights

You have the following rights regarding your Personal Data that we hold:

  1. Informed – transparency in how your Personal Data is processed such as outlined in this Privacy Notice.
  2. Access your data – request a copy of your Personal Data that we process about you.
  3. Rectify your data – request us to amend or update your Personal Data where it is inaccurate or incomplete.
  4. Erase your data – request us to delete your Personal Data where it is no longer necessary for the purposes for which it was originally collected.
  5. Restrict your data – request us temporarily or permanently to stop processing all or some of your Personal Data.
  6. Receive or transmit your data in a machine-readable and structured format (data portability);
  7. Object to the use of your data – object to us processing your Personal Data where it is based exclusively on our legitimate interests or for direct marketing purposes; and
  8. Object to automated decision-making – request us not to subject you to decisions based solely on automated processing, including profiling.
  9. Withdraw your Consent: Where we rely on your consent to process your Personal Data, you can withdraw your consent at any time.

We will also exercise any other rights that may be applicable under applicable data privacy laws.

We endeavour to respond to you within 30 days from when we can verify your request as legitimate. Occasionally we may not be able to give you access to the Personal Data we hold about you (for example, we may not be able to give you access if it would unreasonably affect someone else’s privacy or if giving you access poses a serious threat to someone’s life, health or safety).

Please note that we may apply an administrative charge for providing access to your information in certain circumstances, if permitted by applicable law. Any such charge will be reasonable and we will advise you of the charge and obtain your consent before providing you with access to your Personal Data.

Making a Complaint

If you feel that we do not comply with applicable data protection and data privacy laws or adequately address any concerns, you may lodge a complaint with a competent data protection authority.

If you feel that your Personal Data has been misused or disclosed without your permission, or that any of your data privacy rights have been violated by Presight, an ADGM registered company, you have a right to file a complaint directly with the ADGM Office of Data Protection.

We may update this Privacy Notice from time to time in response to changing legal, regulatory or operational requirements. We will notify you of any such changes (including when they will take effect) through email where we have collected this through the Services and on our website. Your continued use of our Services after any such updates take effect will constitute acceptance of those changes. If you do not consent to such updates, you should cease using Presight’s Services.

You must have reached the minimum age as set out under applicable data protection laws to share your personal information with Presight, or you must have received permission from your parent or guardian to do so.
